Use by a Canadian of a U.S. trust for tax avoidance purposes?

Suppose some Canadian citizen is anticipating a huge windfall from an investment, and tries to avoid Canadian tax on the benefit by gifting an investment expected to grow by leaps and bounds to a taxable U.S. trust, with the trustor (one administering the trust) being himself or perhaps someone with whom he has a non-arms-length relationship, and the trustee (person designated as the beneficiary of the trust) being himself or another at non-arms-length. A huge dividend being placed into the trust is hoped for, along with large capital appreciation, although hardly certain at this point, and the value of the investment even after the dividend would hopefully skyrocket. The trust would pay U.S. dividend tax, which is much lower than the Canadian tax the individual would have to pay. The trust would not have its assets “repatriated,” except in small amounts (which would be taxable at Canadian rates, of course), but would instead buy things in the name of the trust that the person who owns the trust would benefit from, e.g., a house in Canada where the person would live for a tiny rent, or a timeshare the person could use for vacationing. Is there any point in the playing out of this scenario where the person trying to avoid tax would be hit for Canadian or even American tax? Would the assets bought by the trust to be used by the individual be deemed as income repatriated by the individual, even if they were hard assets, such as real estate? Would there be fines incurred due to the non-arms-length arrangements, if the person did not declare the setup of the trust and all its transactions to Canadian authorities. Is there a kind of American trust that would operate below the radar, legally, that the person could use instead?

I love photography, and I have an old camera that I would love to use (I can use respooled film in it). The problem is that I don’t have a dark room. Part of the fun of doing film photography is being in the dark room. So then I got to thinking, how many other people feel the same way? Would like to do film photography but can’t afford a dark room?

So here’s my idea. Get a building and put in several dark rooms. People can “rent” or pay for membership (or something like that) to be able to use the dark rooms and set up specific times to be there (I guess a little like a timeshare). Then the fees would go for chemicals and stuff like that.

I think it might be feasible IF you offered darkroom classes. This could be a tie-in with the Boy Scouts for their Photography Merit Badge. You could also try to contract with local high schools who don’t have darkroom facilities or might need someone to teach darkroom classes outside the regular school environment.

For pricing you’ll need to charge enough to cover your expenses and time. Include 1 pack of 5X7 enlarging paper and sell the 8X10 and larger sizes.

Having digital capabilities would be advisable.

This election has me very worried. So many things to consider. About a year ago I would have voted for Obama. I have changed my mind three times since then.

I watch all the news channels, jumping from one to another. I must say this drives my husband crazy. But, I feel if you view MSNBC, CNN, and Fox News, you might get some middle ground to work with. About six months ago, I started thinking ‘where did the money come from for Obama’. I have four daughters who went to College, and we were middle class, and money was tight. We (including my girls) worked hard and there were lots of student loans.

He is very open about his two years at Occidental, he tried all kinds of drugs and was wasting his time but, even though he had a brilliant mind, did not apply himself to his studies. ‘Barry’ (that was the name he used all his life) during this time had two roommates, Muhammad Hasan Chandoo and Wahid Hamid, both from Pakistan.

During the summer of 1981, after his second year in college, he made a ’round the world’ trip. Stopping to see his mother in Indonesia, next Hyderabad in India, three weeks in Karachi, Pakistan where he stayed with his roommate’s family, then off to Africa to visit his father’s family. My question – Where did he get the money for this trip? Nether I, nor any one of my children would have had money for a trip like this when they were in college. When he came back he started school at Columbia University in New York. It is at this time he wants everyone to call him Barack – not Barry. Do you know what the tuition is at Columbia? It’s not cheap! to say the least. Where did he get money for tuition? Student Loans? Maybe.

After Columbia, he went to Chicago to work as a Community Organizer for $12,000. a year. Why Chicago? Why not New York? He was already living in New York.

By ‘chance’ he met Antoin ‘Tony’ Rezko, born in Aleppo Syria, and a real estate developer in Chicago. Rezko has been convicted of fraud and bribery this year. Rezko, was named ‘Entrepreneur of the Decade’ by the Arab-American Business and Professional Association’. About two years later, Obama entered Harvard Law School. Do you have any idea what tuition is for Harvard Law School? Where did he get the money for Law School? More student loans?

After Law school, he went back to Chicago. Rezko offered him a job, which he turned down. But, he did take a job with Davis, Miner, Barnhill & Galland. Guess what? They represented ‘Rezar’ which Rezko’s firm. Rezko was one of Obama’s first major financial contributors when he ran for office in Chicago.

In 2003, Rezko threw an early fundraiser for Obama which Chicago Tribune reporter David Mendelland claims was instrumental in providing Obama with ‘seed money’ for his U.S. Senate race. In 2005, Obama purchased a new home in Kenwoood District of Chicago for $1.65 million (less than asking price). With ALL those Student Loans – Where did he get the money for the property? On the same day Rezko’s wife, Rita, purchased the adjoining empty lot for full price. The London Times reported that Nadhmi Auchi, an Iraqi-born Billionaire loaned Rezko $3.5 million three weeks before Obama’s new home was purchased. Obama met Nadhmi Auchi many times with Rezko.

Now, we have Obama running for President. Valerie Jarrett, was Michele Obama’s boss. She is now Obama’s chief advisor and he does not make any major decisions without talking to her first. Where was Jarrett born? Ready for this? Shiraz, Iran! Do we see a pattern here? Or am I going crazy?

On May 10, 2008 The Times reported, Robert Malley advisor to Obama was ‘sacked’ after the press found out he was having regular contacts with ‘Hamas’, which controls Gaza and is connected with Iran. This past week, buried in the back part of the papers, Iraqi newspapers reported that during Obama’s visit to Iraq, he asked their leaders to do nothing about the war until after he is elected, and he will ‘Take care of things’.

Oh, and by the way, remember the college roommates that where born in Pakistan? They are in charge of all those ‘small’ Internet campaign contributions for Obama. Where is that money coming from? The poor and middle class in this country? Or could it be from the Middle East?

And the final bit of news. On September 7, 2008, The Washington Times posted a verbal slip that was made on ‘This Week’ with George Stephanapoulos. Obama on talking about his religion said, ‘My Muslim faith’. When questioned, ‘he made a mistake’. Some mistake!

Those voting for Obama are blind to the truth. They are willing to believe anything that he says and discounts all negative FACTS as rhetoric. Why do you think that his campaign is forcefully seeking out the poor and uneducated population that has never voted in the past? They are so vulnerable to the power of suggestion. They think that if Obama becomes president, that they will get out of poverty. That is the farthest thing from the truth! If it were true, the democrats would have brought them out of poverty years ago and poverty would be non-existent today!

Your Questions About Travelocity Hotel

Are travel websites like travelocity and expedia really chepaer and easier?

I’m starting to plan a honeymoon for June and I’m thinking of going to Lake Tahoe, NV. Is it really cheaper and easier to get a package flight/hotel/car deal with a travel website or should I do all that stuff separately on my own?

Any advice is appreciated!

If you don’t have an exact hotel, lodge or resort in mind you can get some great deals on priceline, but that doesn’t sound like how most people plan a honeymoon.

Generally you’re going to do better on total price by doing everything separately but you’ll have to work at it. Use kayak to find flights, check the individual rental car sites for prices because they always seem to be lowest direct from the car company and then use hotels.com and travelocity to find a hotel/lodge and compare with the direct booking price at the hotel/lodge.

We’ve found the lowest price at any and all of them at various times so you just have to look everywhere if you’re really dedicated to getting the lowest price. Sometimes it’s just not worth it though if your time is worth anything.

I had originally booked with hotel Plus for $100 a night, but for some reason the actual hotel doesn’t want to honor that price anymore and wants me to pay $147 a night… I’m trying to find the cheapest rates for Best Western Dobson Ranch Inn in Phoenix, AZ… what should I do, please HELP!!!

When you said you booked with hotel Plus for $100/night, have you already paid them for this, and has you reservation been confirmed? If yes, you should have a booking voucher which proves that you have already paid them and there’s no need for you to pay any additional fees. If not, then maybe you weren’t able to meet their deadline for paying the reservation at $100/night. This means that your original reservation has already been canceled and you have to reserve anew. With the new reservation, you can only follow whatever rate the hotel gives you now.

Rush Limbaugh had the following exchange on his show:

If there’s a liberal bias in the U.S. media why is Clear Channel’s CEO defending Rush? Is it simply that his show is profitable while Maher’s was less so?
Hoptoad – thanks for the answer. I agree that Rush’s comment wasn’t “conservative” (and would suggest that Maher’s comment wasn’t “liberal”). Still Rush is a well known pundit generally on the right and Maher is well known for his positions on the left. I think that if Maher ever used the phrase “phony soldiers” at any time (much less a time of war) even HBO would be hard pressed not to take him out to the woodshed. Does Rush get more freedom to make stupid remarks because he’s conservative (even when his comments aren’t) or is it simply ratings driven?

What Rush said was not liberal or conservative, it was just stupid. What Bill Mahr said was just insensitive in a time when the country was mourning the loss of so many of our citizens. ABC didn’t want to keep someone around who makes their company look bad. Plus, Rush is way more popular than Maher, if he left clearchannel his listeners would go with him.

Who wants to see Stanley Kubrick’s verson of “Eyes Wide Shut”?
Maybe this is Hollywood urban legend, but I remember Siskel or Ebert giving the movie a mega-rave review along with other critics, pretty well in advance of its theatrical run.

The urban legend part of this is, I recall Siskel (or Ebert) explaining their opinion of the movie after it opened and was apparently a piece of garbage. The story went on that the version that critics stated they loved was an edit of Kubrick’s that the studio mutilated upon his death.

So if this is true, and already I have found that Wikipedia has an alternate story, is there anyone else that would love to see this as much as me?

And please folk, lets try to put aside our unretrained Tom Cruise hatred for this one question. He’s a couch-jumping-scientoligical-loony toon, i get that. this is about a movie by a great artist that the Hollywood machine destroyed (allegedly)

I saw this movie the first day it was released back in 1999. And I am a huge Kubrick fan, owning all of his movies. But this is the only one of his that I don’t know what to make of. It was not bad, but I can’t rave about it. It’s a very psychological and cerebral film. I apologize that I’m not familiar with the Siskel and Ebert review.

Death at a sparked rate – a menacing rhythm
That beat to the unsolved cases exposing the glitch in the system

I used to wonder how Sarah Palin (who accepted a VP bid from a lifetime moderate Republican) managed to become the face of the “tea party (at least according to the MSM). The same tea party that is currently ousting moderate Republicans in primaries.

Turns out, the SAME Republican group that pushed for a John McCain victory under the PAC name “Our Country Deserves Better” in 2008 simply changed it’s name to the “Tea Party Express” after they realized people basically loathed the Republican establishment.

This “Tea Party Express” PAC (formerly Our Country Deserves Better), a Republican group, is currently funding Sarah Palin’s bus tour around the country.

So would you say the Republican party has successfully hijacked the name and rhetoric of the “tea party”?
Also, do you think all the people who ACTUALLY believe in “limited government” and a reduction in federal spending will let the GOP screw them again? (George W. Bush ran on a platform of limited government and no nation building in 2000)

Issue Background: CAFE Standards

CAFE standards—short for Corporate Average Fuel Economy—dictate the number of miles per gallon that an automaker should get for the range of vehicles it sells. Originating during the energy crisis of the 1970s, they represented the federal government’s attempt at reducing fuel consumption by boosting the fuel economy of cars and light trucks.
The standards ushered in an early surge in fuel economy for new cars and trucks. But CAFE requirements haven’t changed much in more than a decade—and neither has the gas mileage of the vehicles Americans drive.

Current Standards

▪ The current standard is 27.5 mpg for passenger automobiles. The light-truck standard—a classification that also includes SUVs under 8,500 pounds—rose to 22.2 mpg for model-year 2007.
▪ Large vehicles—those weighing more than 8,500 pounds—aren’t covered by fuel-economy standards at all. Back in the ’70s, lawmakers assumed that anything that large would only have industrial uses. It was inconceivable that an American family might actually cruise around in a vehicle the size of a Ford Excursion or Hummer, which get very low gas mileage. The Hummer, for example, is not officially tested for fuel efficiency, but reports suggest it gets only 11 mpg.
Issues with CAFE Standards

▪ The Environmental Protection Agency (EPA) has long been criticized for the testing procedure it uses to gauge fuel economy. The current EPA method, introduced in the 1970s, is based on outdated assumptions: that motorists drive slower than they really do, that they never use air-conditioning, never go up a hill, never start their cars in the cold, never get stuck in traffic jams, etc.
▪ In 1985, the EPA tried to make up for these shortcomings by adjusting fuel-economy numbers downward by 10 percent for city driving, and 22 percent for highway mileage. The revised figures were slightly more realistic, but critics argued that they still failed to account for real-world driving conditions that can drag down gas mileage.
▪ In 2006, the EPA proposed adding tests to simulate high-speed driving, rapid acceleration, and stop-and-go traffic, among other factors. The new system will likely slash mileage ratings for many models by 10 to 20 percent for city driving. These tests are expected to go into effect for model-year 2008.
▪ However, the new tests won’t affect whether vehicles are judged to be in compliance with CAFE standards, since the auto industry won a lawsuit against the EPA to prevent it from using new mileage numbers for CAFE purposes.

CAFE Standards and Actual Fuel Economy

▪ The average fuel economy of new vehicles—cars and trucks combined—has actually declined slightly since 1990. The reason: American drivers have increasingly switched to driving SUVs and trucks (they account for half of all new vehicles sold), which use more gas than passenger cars.
▪ CAFE standards also haven’t changed much. Supporters argue that the standards would be more effective if lawmakers would raise current standards to account for the extra fuel economy that is feasible using new technologies. But others say the whole program has been a failure; they want to do away with the standards altogether.

Technology for Improving Fuel Economy

▪ Supporters of higher CAFE standards note that the technology already exists to make vehicles get at least 10 more miles per gallon, and it could be incorporated into cars in a cost-effective manner.
▪ One study found that, when gas costs more than $2.30 a gallon, technologies that raise fuel-efficiency to around 33 mpg across the fleet pay for themselves within three to four years.
▪ According to at least one expert, even big cars could save a lot of fuel with improvements, such as six-speed automatic transmissions, cylinders that shut down when they are not needed, and improved aerodynamics and materials. For an extra $1,000, a conventional, gas-powered car could potentially go 25 percent better fuel economy.

My boyfriend and I are planning a three night stay in Las Vegas in April and I have no idea how much spending cash I should save up for the trip. I’m not a big gambler so little money will be spent there…

Honestly, it depends on what you like to do- shopping, fine dining, shows, clubs, etc. Typically, my husband and I have btwn $800-$1000 total for a 3 night stay (keep in mind we gamble and like fine dining). That’s $400-$500 each. You can save alot by signing up for casino cards but you would need to gamble a bit to get the freebies. You can check show tickets half price from ticket booths on the strip and if you are willing to dedicate t least 2 hours to a timeshare presentation you can get all kinds of stuff. We have gotten cash, dinners, gondola rides, free admission to Madam Tussuad’s Wax Museum, show tickets just for attending.

I went to a timeshare presentation and in the end I received a couple voucher’s to send for two trips, both paying airfare and hotel stay.

Usually they are “tagged” to you, and you alone, and in the fine print you’ll probably see that they are not transferable. The problem can arise when the person you sell them to tries to get on the plane, with a ticket in your name, but with a different name & picture on the driver’s license…they just might end up with some free room & board per the state.

Timeshares do not have resale value and in most situations you would take a loss in what you paid for, as they resale for less than $2000 USD.

This will pressure the developer specially if they sell it for $20,000 USD and you offer it for $5,000. Sometimes on the fine print of some sale agreements says that the developer has the first right to buy if your place is ever sold. I have heard of developers paying the money (as long as is not too much) just to take the sign out.

Here is the research I did before choosing a company:
I used Google.com and typed in MANY key word BUYER terms (buyer terms like “buy timeshare” “buy (resort name) timeshare” or “buy (resort state) timeshare”) to find the company that actual buyers would most likely find first. I wrote down the company url’s and did the following research on the companies I found:

1. I checked the BBB report on the company
2. I made them provide traffic and offer reports
3. I searched online for complaints about the company.

All this took me a couple hours (the final decision took days!)
I also posted on free sites at the same time and recommend you do the same as well.

The previous answer had a good idea about checking travel sites, but don’t forget to check with a traditional travel agent. They run specials too and sometimes have very good deals. If you’re in the northeast, I highly recommend Liberty Travel, the people there are always very helpful.

I Feel bad about leaving my kids to go for a weekend getaway. Any advice?

I have a 2 and 4 year old and am planning a 4 day 3 night trip with my husband to get away before baby number 3 arrives (I’m 3 months pregnant). I’m leaving them with their grandmother. I feel so bad for them cause they’ll miss mommy and daddy. I’ve never left them for this long. I’m afraid I won’t have fun because I’ll be worried and missing them BUT… I really need this break and I haven’t been on a vacation for many years. Any advice to ease the pain of leaving them? Honey, I could go on all day! I understand how you feel, b/c I have 4 kids myself! Only…we are not fortunate enough for them to have great grandparents that love to spend time with them, so our getaways are way to few and far between! I DREAM of going on a weekend break w/out my children,..and yes, I feel bad about those thoughts sometimes, but hey, I never saw a rulebook that said just because you have kids, you don’t deserve a life anymore!!!! You are a person, and are worthy of enjoying time with your husband and time alone to pamper yourself! And the fact that you are a mom, makes you even MORE worthy of those things than a childless woman. Afterall, a happy mommy makes a better mommy! :) (much better than an over-stressed one). So relax and enjoy it while you can!

I’m looking for LEGITIMATE ways to make money from home after I have my daughter around the end of August. It seems like so many of the things I find online are scams, offering all of this money to applicants with no experience, but they usually want you to buy materials and I’m sorry, I’m not going to pay money to get a job. I have really good telephone skills and decent computer and typing skills. I’d love to hear from you if you personally work from home, or have a close friend/family member that does. Any recommendations or warnings? This is my first child, and while I still have to work to make ends meet, I’d really love the chance to be home with her as much as possible.

If you have good people skills, then maybe you should try Avon or Pampered Chef. These are good jobs for stay at home moms. You have to host Avon/Pampered Chef parties, which usually take an 1-2 hours. These are usually during the evening or weekends, so if you have someone to watch your daughter this is a great way to make money!
Also, you could run a small, at-home daycare. You could have a friend or neighbor help run it. There’s certain state laws to how many kids you can have compared to the adults watching them. But a daycare is also a good way to make money. I know that option probably isn’t the best,because you said you wanted to spend time with your daughter, and having a couple other kids running around would be kind of hard. But if you pick the age range wisely, you may be able to spend more time with your daughter.
You said you have pretty decent typing skills, maybe you could try writing childeren’s books. They don’t have to be best-sellers, but if you get published, that’s pretty good money. However, I would recommend trying that once you have a pretty stable job.

If you live in the US and are interested in being a virtual rep for a company, send me an email through my profile and I will forward links to 2 sites that list legit companies who PAY. Bear in mind these are JOBS and pay either by the hour, project, etc… Normal pay scales as if you were actually working in the office, etc… Expect an application process, interviews, perhaps testing (dependent on the company and position)

I worked as a virtual rep for one of the companies on the list… There are REAL companies, but they don’t have to advertise or pay google adword type stuff as they get plenty of referrals through word of mouth.

I have been working online for several months already. I usually work 2 to 3 hours a day or only when i am free. I write articles, transcribe, and make researches which is actually quite rewarding. In contrary to many websites that offer easy money, working on some tasks would ensure that you will be getting your time’s worth. I also tried makeup and fragrance selling before too, but it was very difficult because of the demands of my full time work.

Where to report scams (in Canada)?

I’m planning on starting a business, and I was looking for grants or loans. I found “Centre for National Business Development” which turned out to be a total scam, but it claims to be run by the federal government. You can’t tell it’s a scam unless you contact them by email (their reply email is suspicious, so I looked them up on BBB, and found lots of complaints).

It’s hard to find info on them. My first BBB search didn’t turn up anything, so I googled them, and it turns out they have 3 different websites with 3 different phone numbers, making them hard to track down. It also makes it very obvious that it is a scam, once you do find the 3 different websites, but people who contact them by phone won’t know that.

I just want to know where to report this. I don’t think municipal police deal with this sort of thing, so where do I go? RCMP?

I know probably no one cares about the little “work from home” type scams, but this is someone pretending to be a government agency, and doing a good job of it; I think that’s serious enough that it should be dealt with.

I’ve been looking for work via craigslist..?

I have emailed a ton of people this past month. I got a response from one of the companies saying they offer work from home via telecommuting. I emailed them back saying that sounded great. well today i received a package via ups with 2 money orders each 850. when i emailed the company they didn’t claim it was from them. i remember receiving an email from the person who sent me the money order but it had gone to my spam and deleted it. anyone no of any scams like this? where someone sends you a money order

This sounds way too good to be true. Definately sounds like a scam. I’ve heard of scams that are similiar but instead the employee sends the money and gets ripped off. Is it a legit money order? Does it look fake in any way?

They could somehow use the money order to get your bank information, if that’s possible. Craigslist has a ton of scams not just in the job section but even in the for sale and pet sections. People were posting pictures of animals in the shelters saying that they animals were for adoption and telling the people that they just needed to send the adoption fee to them. But they didnt even work for the shelter.

You just really need to be careful. I wouldn’t persue this “job”.

I’m a single mother working part-time right now and have been looking into working from home at the computer for an online business or creating an e-bay sellers account. Your Questions About Business Plan

What exactly needs to go into a business plan?

My fiance and I are wanting to start our own business soon, and we need to draw up a business plan.

I’m at a bit of a loss as to what exactly needs to go into one as I’ve never written one before.

Any help will be greatly appreciated!

I wrote one last year as part of a business class. It was a lot of hard work, but I think worth the effort.

Mine has:
-Cover page
-Executive Summary (basically a shorter version of what the plan includes)
-Title page
-Business description
-Management and Organization
-Marketing Plan
-Operational Considerations
-Growth Plan
-Contingency Plan

Then at the back, for whatever reason, I have my resume, reference page, sample letterhead and sample business cards.

So, a lot. I agree with the other answer that a book would be of great help to you–mine was simply for a class, and I know there was a lot of work involved. My best advice is to spare nothing in making it as clean, organized, professional, and *interesting* as you possibly can.

Does the business plan include a prospal letter, or do you need both, if your requesting grants, loans, or a financial jump start. What’s the difference between your business plan and or your prospal letter, Is it telling the needs and requesting the needs?

Do both – not only is it good for the grants and loans but it also helps you to clarify what you plan to do and the time frames. I started my business in January with the help of a government loan and we had to do a proposal letter, a business plan, a projected cash flow and many other documents that have proved very helpful to me in operating my small business. If you live in Canada, you can apply for the same grant – it’s called the Self Employment Benefits plan, and is run by the Employment Insurance office. They give you great training (two weeks in class) and tons of support, as well as close to $13,000 over 8 months that you do not have to repay. You can also apply for loans up to $5,000 to get off the ground.

If your credit is questionable, or you want more dough than a bank might give you-or its higher risk than a bank will allow-go to a venture capatalist-get their provisions to the deal, then take it to an attorney to make sure the provisions are fair and equitable-and have a conrtract looked at by him/her. If need for ALOT of money is not in your scheme, or your credit is solid, and your plan solid (in the banks opinion) and you also have collateral….a bank would be a better venue for better rates.
